Terms of Service

By accessing or using LucentSkill (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). Your use of the Service constitutes acceptance of these Terms, which is as valid as a written contract. If you do not agree to these Terms, do not use the Service.

LucentSkill is an educational platform that offers AI upskilling courses, exercises, and AI-graded feedback. The Service and all of its features are experimental in nature and are provided on an "as is" and "as available" basis.

We are building LucentSkill solely to help people learn. Our intent is to assist you. However, you acknowledge that AI systems are inherently unpredictable, and we make no guarantee that any feature will function as described, produce accurate results, or remain available.

To use certain features, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use.

Exercise submissions may be processed by third-party AI providers for the purpose of automated grading and feedback. AI-generated grades, scores, and feedback are provided for educational purposes only and may be inaccurate, incomplete, or misleading.

The educational content on LucentSkill is provided for general informational purposes and does not constitute professional, legal, financial, or employment advice. Completing modules or earning XP or badges does not confer any industry-recognized certification, credential, or qualification.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. You are voluntarily choosing to use the Service. We do not require, compel, or mandate that you use any feature. Creating an account and using the Service is entirely your choice.

You accept all risks associated with the Service, including but not limited to: inaccurate AI grading, loss of data, service interruptions, and reliance on content that may be incorrect. You are solely responsible for any decisions you make based on content or feedback from the Service.

You are solely responsible for all content you submit to the Service, including exercise answers and any other material. You are responsible for reviewing AI-generated feedback before acting on it. You agree to comply with all applicable laws and third-party terms in connection with your use of the Service.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Impersonate any person or entity.
• Submit false, fraudulent, or malicious content.
• Attempt to gain unauthorized access to the Service or its systems.
• Interfere with, disrupt, or reverse-engineer the Service.
• Scrape, harvest, or resell content from the Service without consent.
• Upload malware or any harmful code.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide license to store, process, and use that content solely to provide and improve the Service.

LucentSkill, its curriculum, branding, design, and underlying software are the property of LucentSkill and its licensors. You may not copy, modify, or distribute them without our prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUCENTSKILL, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to: lost profits, lost opportunities, reputational harm, emotional distress, or any reliance on AI-generated content or grading.

LucentSkill and its owners’ total aggregate liability to you shall not exceed zero dollars ($0.00). If a court of competent jurisdiction finds this unenforceable, the cap shall be one dollar ($1.00). This reflects the at-your-own-risk nature of the Service and is a fundamental element of the bargain between you and us.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no warranty that the Service will be uninterrupted, accurate, secure, or error-free.

You agree to indemnify, defend, and hold harmless LucentSkill, its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and legal costs) arising out of or related to: (a) your use of the Service; (b) any content you submit; (c) your violation of these Terms; (d) your violation of any third-party right; or (e) any dispute between you and any third party arising from your use of the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

We may modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Service after any change constitutes acceptance of the updated Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, and without notice. You may stop using the Service and delete your account at any time.

You agree that any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, and not in a court of law or as part of a class action. You waive your right to a jury trial and to participate in any class, collective, or representative action.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and LucentSkill regarding the Service.
